Terms

 1. Scope 

These General Terms and Conditions (“GTC”) of the Rockhouse Salzburg association, Schallmooser Hauptstraße 46, 502 Salzburg (“Rockhouse”), govern the purchase of tickets, value vouchers, merchandise and other services via the Rockhouse website, at the Service Center, at the box office or via other points of sale operated by the Rockhouse Salzburg association and apply to customers who are consumers within the meaning of Section 1 of the Austrian Consumer Protection Act (KSchG) (“customer”). Every purchase is subject to the GTC published on the website at the time the contract is concluded. 

In addition, the house rules of the respective venue as well as any event-related notices apply. 

If deviating conditions are expressly announced for individual events, products or services, those specific conditions take precedence over these GTC. 

All notifications from the customer in connection with and/or relating to purchases on this website — including notices, complaints and questions regarding the purchase and/or delivery of the products, the exercise of the right of withdrawal etc. — must be sent to service@rockhouse.at. 

2. Contracting parties and organizer 

The contractual partner for the purchase of tickets, merchandise or value vouchers is generally Rockhouse, unless another organizer, seller or provider is expressly identified. 

For Rockhouse events, the organizer is the Rockhouse Salzburg association. 

For events at the Rockhouse Bar, the organizer is Rockhouse Bar Gastronomie GmbH. In these cases, the contract is generally concluded between the purchaser or visitor and Rockhouse Bar Gastronomie GmbH.  

For guest events, the guest organizer identified for the event is the organizer. In these cases, the contract is generally concluded between the purchaser or visitor and the respective guest organizer. 

In these cases, Rockhouse may act in particular as a point of sale, intermediary or processing office. 

If the Rockhouse website links to external ticket providers or sales platforms, the purchase is made exclusively through the respective external provider.  

3. Tickets and admission 

Each valid ticket entitles the holder to attend the event stated on it. Tickets must be shown at admission without being asked or on request. For reduced-price tickets, proof of entitlement to the reduction must be presented on request. 

Tickets may not be used abusively, copied, altered or manipulated. If manipulation, misuse or unauthorized use is suspected, admission may be refused. 

In the event of loss of a ticket, there is no entitlement to a replacement. 

4. Print@Home tickets and digital tickets 

Print@Home tickets and digital tickets are provided electronically or sent to the email address given during the ordering process after the purchase has been completed successfully. 

The customer is responsible for ensuring that the ticket can be presented legibly at admission. This can be in printed form or, if technically possible, digitally on a mobile device. 

Print@Home tickets and digital tickets are valid only once. If the same ticket is presented multiple times, admission is generally granted to the person whose ticket is checked first. Rockhouse assumes no responsibility for tickets copied, passed on or used multiple times abusively, insofar as this is legally permissible. 

Damaged, illegible or technically uncheckable tickets may be rejected if a clear validity check is not possible. 

Rockhouse is not liable for disadvantages arising from the customer or purchaser providing an incorrect email address, failing to retrieve the ticket in time, or being unable to present the ticket legibly at admission. 

5. House rules and conduct in the event area 

By purchasing a ticket and/or entering the venue, the visitor acknowledges the house rules of the respective venue. The instructions of staff, security personnel and other authorized persons must be followed. 

Visitors may be excluded from the event or removed from the premises if they violate the house rules, safety regulations or lawful instructions, or if they endanger, harass or seriously disturb other visitors, artists, employees or authorized persons. 

In these cases, there is no entitlement to a refund of the admission price. 

6. Prices, payment and fees 

The prices announced at the time of purchase apply. Additional fees, in particular system, processing, service, shipping or other additional fees, will be shown before the purchase is completed. 

Payment is made using the means of payment offered in each case. There is no entitlement to any particular payment method. 

Tickets, merchandise and value vouchers are only valid or handed over after full payment has been received. 

7. Online purchase and conclusion of contract 

The presentation of events, tickets, merchandise or value vouchers on the website does not yet constitute a binding offer. The contract is only concluded once the purchase process has been completed and an order confirmation has been sent by Rockhouse or by the respective payment, ticketing or shop system. A confirmation of receipt is not an order confirmation. 

The customer is obliged to provide correct and complete information during the ordering process. Incorrect information, especially email addresses, is at the customer's expense. 

In the event of any typing, printing or calculation errors, Rockhouse reserves the right to withdraw from the contract. The actual colors of a product may differ in part from those shown in the photos. 

Orders may only be placed by persons who are at least 16 years old. 

8. Cancellation, postponement and changes to events 

If an event is cancelled, there is an entitlement to a refund of the ticket price. Refunds are generally made via the point of sale or platform through which the ticket was purchased. 

Service, processing, shipping, system or other additional fees are excluded from the refund. 

If an event is postponed to another date, tickets already purchased generally remain valid for the replacement date. However, if the customer wishes, they are entitled to a refund of the ticket price in the event of a date change. In the case of a change of venue within a reasonable radius (e.g. Szene Salzburg, Messezentrum, Zentrum für Visionen or comparable), tickets already purchased generally remain valid; in this case, a refund or price reduction is not possible. 

Minor or objectively justified changes, in particular to the schedule, start times, support acts, lineup, running order or equivalent program components, generally do not entitle the holder to return, exchange or price reduction. 

Further claims exist only in accordance with the statutory provisions. 

9. Rockhouse Bar events 

Rockhouse Bar events are, unless expressly stated otherwise, organized by Rockhouse Bar Gastronomie GmbH. Rockhouse may advertise such events on its website and/or provide technical or organizational support for ticket sales. 

Rockhouse Bar Gastronomie GmbH is generally responsible for execution, cancellation, postponement, program design, processing of refunds and other event-related claims. Claims against Rockhouse are excluded. 

10. Guest events 

For guest events, content-related, organizational, financial and legal responsibility lies with the respective guest organizer, unless Rockhouse is expressly identified as the organizer itself. 

The respective guest organizer is in particular responsible for the execution, program, lineup, start times, cancellation, postponement, official permits, processing of refunds and any claims by visitors in connection with the event. 

If Rockhouse sells or advertises tickets for guest events, this is generally done in the name of or on behalf of the respective guest organizer or as a pure sales or processing service, unless expressly stated otherwise. 

Refunds in the event of cancellation or postponement of guest events are made in accordance with the statutory provisions and the specifications of the respective guest organizer via the point of sale through which the ticket was purchased. 

11. External ticket links 

For individual events, reference may be made to external ticket providers or other sales platforms. 

In this case, the ticket purchase is not made via Rockhouse, but via the respective external provider. The external provider's terms and conditions apply to payment, conclusion of contract, processing of refunds, customer service and data protection. 

Rockhouse accepts no responsibility for the functionality, availability or contractual processing of external ticket platforms. 

12. Transfer and resale of tickets 

Private transfer of tickets is permitted, provided it is not abusive and no event-related restrictions stand in the way. 

Commercial resale, sale at inflated prices, or the use of tickets for competitions, promotional purposes or other commercial purposes is not permitted without the prior consent of Rockhouse or the respective organizer. 

In the event of a breach of these provisions, Rockhouse is entitled to block the affected tickets or cancel orders. Amounts already paid will in this case be refunded in accordance with the statutory provisions. 

13. No right of withdrawal for event tickets 

The right of withdrawal in distance selling pursuant to Section 11 of the Austrian Distance and Off-Premises Contracts Act (FAGG) does not apply to the purchase of event tickets, as such services by Rockhouse are leisure services within the meaning of Section 18(1) No. 10 FAGG. 

14. Merchandise and goods sales 

For the purchase of goods, in particular merchandise items, sound carriers, textiles, books or other products, the provisions of this section apply in addition. The presentation of goods on the website does not constitute a binding offer. The contract is only concluded upon confirmation of the order. 

The goods remain the property of Rockhouse until full payment has been made. The statutory warranty rights apply to goods. 

15. Delivery, shipping and collection of goods 

Goods can, where offered during the ordering process, be shipped or collected at Rockhouse. The shipping and collection options available in each case are shown during the ordering process. 

Delivery is made to the delivery address specified by the customer. 

Shipping costs are shown before the order is completed. 

In the case of shipping, the risk of loss or damage to the goods passes only when the goods are handed over to the customer or to a person authorized by the customer to accept them. 

If collection is selected, the customer will be notified as soon as the goods are ready for collection. Collection takes place during the announced opening hours. 

If goods are not collected within a reasonable period, the Rockhouse Salzburg association may request the customer to collect them by setting a reasonable grace period. 

16. Right of withdrawal, cancellation for goods 

When the customer purchases goods online, there is generally a statutory right of withdrawal under the Distance and Off-Premises Contracts Act (FAGG), provided no statutory exception applies.  

Withdrawal 

The customer has the right to withdraw from a distance contract within 14 days without giving reasons. The withdrawal period is 14 days from the day on which the customer or a third party named by the customer, who is not the carrier, takes possession of the goods. In the case of an order for multiple goods delivered separately, or for a good delivered in several partial shipments or pieces, the withdrawal period begins on the day on which the customer or a third party named by the customer, who is not the carrier, takes possession of the last good, partial shipment or piece. 

To exercise the right of withdrawal, the customer must inform Rockhouse at the following address

by means of a clear statement (e.g. a letter sent by post, fax or email) about the decision to withdraw from this contract. The following model withdrawal form may optionally be used for this purpose. 

To meet the withdrawal deadline, it is sufficient that the notice of exercising the right of withdrawal is sent before the withdrawal period expires. 

Consequences of withdrawal 

If the customer withdraws from the contract, Rockhouse will reimburse the customer for the purchase price without undue delay and no later than within fourteen days from the day on which the notice of withdrawal was received by Rockhouse. You bear the direct costs of returning the goods. For this repayment, Rockhouse will use the same means of payment used for the original transaction, unless expressly agreed otherwise. In no case will fees be charged to the customer for the repayment. If the means of payment used for the original transaction is not available for the repayment, the refund will be made by bank transfer to a bank account specified by the customer. 

The customer only has to bear any loss in value of the goods if this loss in value is due to handling the goods that was not necessary to examine their condition, characteristics and functioning. 

The customer must return the goods without undue delay and in any event no later than fourteen days from the day on which the customer informed Rockhouse of the withdrawal to

. The deadline is met if the goods are sent before the fourteen-day period expires. Rockhouse may refuse reimbursement until it has received the goods back or until the customer has provided proof that the goods have been returned, whichever is earlier. 

Special notes: 

There is no right of withdrawal 

  • for goods made to customer specifications or clearly tailored to the personal needs of the customer. 

  • for audio or video recordings or computer software (e.g. CDs, DVDs, Blu-ray) supplied in sealed packaging if the seal has been removed after delivery, 

  • for goods that can spoil quickly or whose expiry date has passed, 

  • for magazines, newspapers or periodicals, except for subscription contracts for the delivery of such publications, and 

  • for services provided in connection with leisure activities, if a specific time or period is contractually stipulated for performance of the contract in each case (e.g. tickets).

The form available via the link above may be used for withdrawal. The withdrawal must contain the following information and be sent to the address below:

17. Value vouchers 

Value vouchers can be redeemed, subject to the respective stated conditions, for services, events or goods offered by Rockhouse. 

Value vouchers cannot be redeemed for events or services offered by other organizers, in particular Rockhouse Bar Gastronomie GmbH or guest organizers.  

Cash redemption of value vouchers is excluded. 

If the value of a voucher is not fully used upon redemption, the remaining value generally remains.  

In the event of cancellation of a purchase paid for (in whole or in part) with vouchers, the amount will be refunded via the same payment method used for the original transaction (including refund to the voucher). If different payment methods were used for the original transaction, the voucher amount will be refunded first and then the remaining amount via the other payment methods. 

Vouchers are transferable. Redemption of the voucher vis-à-vis the respective holder discharges the debt. Vouchers do not bear interest and cannot be redeemed for cash, transferred against value or offset against outstanding payments. Resale of vouchers is not permitted. 

In the event of loss, theft or abusive use of a value voucher, there is no entitlement to a replacement, unless entitlement can be established beyond doubt. 

18. Data protection 

Information on the processing of personal data, in particular in connection with ticket purchases, value vouchers, merchandise orders, newsletters, the website, payment processing, photo and video recordings and customer communication, can be found in the Rockhouse privacy policy. 

19. Amendments to the General Terms and Conditions 

The version of the GTC that was effectively incorporated at the time the contract was concluded shall apply. Rockhouse reserves the right to amend these GTC for future contracts. Contracts already concluded remain unaffected unless legally permissible or expressly agreed. 

20. Applicable law and place of jurisdiction 

Austrian law applies, to the exclusion of conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, insofar as mandatory consumer protection provisions do not prevent this. 

The statutory places of jurisdiction apply. 

21. Severability clause 

Should individual provisions of these General Terms and Conditions be or become wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. 

The statutory provision shall replace the invalid provision.
